The Maternity Benefit (Amendment) Bill, 2016

The Maternity Benefit (Amendment) Bill, 2016 was introduced in Lok Sabha and the Cabinet gave ex-post facto approval to the amendments made to the Maternity Benefits Act, 1961. The Maternity Benefit Act, 1961 that protects the employment of women during the time of her maternity and entitles her of a full paid absence from work to take care for her child, is applicable to all establishments employing 10 or more persons. The amendments include increasing maternity leave from 12 weeks to 26 weeks for two surviving children and 12 weeks for more than two children, 12 weeks maternity leave to a ‘Commissioning mother’ and ‘Adopting mother’ and mandatory provision of creche in respect of establishment having 50 or more employees.

The Factories (Amendment) Bill, 2016

The Factories (Amendment) Bill, 2016 has been passed in Lok Sabha. According to the amendment bill, the overtime work hour, under Section 64, has been doubled from 50 to 100 hours in a quarter and to 125 hours under special circumstances through a special notification. The legislation empowers the Central Government, in addition to the State Governments, to make exempting rules and orders in respect of total number of hours of work on overtime in a quarter, which would ensure uniformity in its application by various state governments and Union territories. Under the Act, such rules will not apply for more than five years. But, the Bill modifies this provision to state that the five-year limitation will not apply to rules made after the enactment of this Bill.
