Insolvency & Bankruptcy Code, 2016
The MCA has taken a new initiative by setting-up a modern insolvency mechanism based on the best practices in the world and the process of setting-up of an insolvency mechanisam including setting-up of the Insolvency and Bankruptcy Board of India (IBBI). The Finance and Corporate Affairs Minister has presented the Certificates of Registration to two Insolvency Professional Agency (IPA) Companies incorporated by ICSI & ICAI. An Insolvency Professional Agency is a front line regulator for the insolvency professionals. It enrolls professional members, lays down standards of professional conduct for them and monitors their performance. It also redresses the grievances of consumers against its members. With the notification of Insolvency and Bankruptcy Board of India (Insolvency Professionals) Regulations, 2016, the IPAs can start enrolling the professional members from 29th November, 2016. This takes one step closer to implementation of the Insolvency and Bankruptcy Code, 2016.
MCA – Annual Filings
MCA has notified on its website that there will be no extension of last date beyond 29th November, 2016 for filing Financial Statements and Annual Returns under the Companies Act, 2013 using eforms AoC-4/AoC-4 (XBRL)/AoC-4 CFS or MGT-7 as the case may be without payment of additional fee for the financial year 2015-2016. Further, additional fee as applicable from the next day of the original due date of the forms shall become payable from 30th November 2016. Stakeholders are requested to plan accordingly and do not wait till the last date for filing the said forms. Further, in order to provide seamless services to stake holders filing company Annual Reports & Financial statements during the peak filing period, New registration of View Public Document (VPD) services may not be available from 11.00 AM to 8:00 PM on 29th November 2016.
